High End Cable

1. Introduction

1.1 The Retention of title on all goods resides with High End Cable until the goods are paid for in full.

1.2 Ownership of goods will belong to the original purchaser only, and any communications will only be through High End Cable and the original purchaser.

1.3 The manufacturer’s guarantee / warranty belong to the original purchaser of the goods, and is not transferable.

1.4 High End Cable do not supply goods on a trial basis without prior arrangement.

1.5 The following terms and conditions (t’s & c’s) apply to all transactions received by High End Cable be it via our Website, email, telephone, fax and / or the mail. The placement of an order through any of these methods indicates your acceptance of our t’s & c’s. High End Cable Terms & Conditions do not affect your statuary rights.

1.6 We may undertake to revise our t’s & c’s from time to time by updating this posting. You should check our website periodically to review our current t’s & c’s. We wish to make clear that our t’s & c’s are binding. Certain provisions of these t’s & c’s may be superseded by expressly designated legal notices and / or terms located on particular pages of the High End Cable website. If, however, you do not wish to recognise any new t’s & c’s after we have given notice, you should refrain from using / visiting the High End Cable website.

2. Security
2.1 Internet Security, High End Cable uses Barclays Merchant Services and Paypal for telephone and online transactions.

3. Proforma payments
3.1 This facility is available by request only. The issue of a Proforma invoice is confirmation of an order placed and subject to any cancellation conditions, see clauses 5.2 and 16.

4. Privacy Statement
4.1 Above all we respect your right to privacy. Any information collected by High End Cable will be kept confidential; we will not sell, re-use, rent, disclose, loan, copy or pass it on to any third party. Any and all information given will be respected and held securely, it will only be held for our own records, e.g. in the unlikely event of warranty claim, and we are required to establish a date of purchase.

5. Description of Goods
5.1 All goods sold are of a technical nature and we are sometimes unable to give full specifications of all our goods. All images, descriptive matter, specifications in our advertisements, relayed by telephone and on the Internet are for the sole purpose of giving an approximate description. Full details of specifications are available from manufacturer’s brochures and / or their websites.

5.2 Special Order Items will not be accepted for refund unless faulty, as the item will be ordered especially for you and subsequently cannot be resold. Orders cancelled prior to delivery, but with proof given that the goods have been received by High End Cable or their agent will be subject to a cancellation charge of 50% of manufacturers/agents list price. Special order items are defined as those items not normally found on the website pages, or provided at lengths, weights and configurations not normally listed. They may also be listed or stated at the time of order as "Special order item(s)".

6. Ordering from High End Cable
6.1 You are deemed to have placed an order with High End Cable by ordering via our Website, email, telephone, fax and / or the mail. We will send you an email or Proforma invoice as an order acknowledgement, detailing the product(s) you have ordered.

6.2 The acceptance of your order takes place when we dispatch or advise you of our ability to dispatch in writing. When we dispatch your order the purchase contract will be made and your card charged accordingly. Except, if we have notified you that we do not accept your order or you have cancelled your order.

6.3 We may refuse to accept an order,
(i) Where goods are no longer available.
(ii) Where we cannot acquire authorisation for your payment.
(iii) If there has been a pricing or product description error.
(iv) If you have not met any eligibility criteria set out in our t’s & c’s.

7. Product & Pricing Information
7.1 All prices unless stated otherwise are in British Pounds - Sterling.

7.2 Our prices include VAT elemnt included by the supplier. We are not VAT registered.

7.3 All prices quoted on our website are shown including delivery, unless stated otherwise.

7.4 Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on our website.

7.5 We recommend that customers keep all boxes and packaging in the event of having to return the goods for any reason.

7.6 We are prepared accept trade ins against the RRP (Recommended Retail Price) against products we sell. We will hold on to the traded in item for 14 days after which time we will start to recover our costs by selling the item. After 14 days the deal is complete, and the client can no longer lay claim to the traded in item or for any loss due to our selling it on.

8. Availability
8.1 All goods and services are subject to availability and may be withdrawn at any time. If the goods are not supplied as specified within a reasonable period of time, we may offer a similar product or will refund you if the transaction is cancelled. We shall not be liable for any losses, costs, damages, charges, or any expenses caused by any delay in the delivery of the goods if they are delivered in a reasonable period of time.

9. Payment
9.1 High End Cable accepts all major credit / debit cards including Visa, MasterCard, AMEX and Switch. You must provide us with your exact billing address and telephone number, which is held with your credit / debit card company. Payment via Proforma invoice is acceptable on the condition that the raising of the Proforma invoice is trated as a firm order and in Special order cases the cancellation conditions apply. Any incorrect information given will cause delays in your ordered being processed and may result in your order being refused.

9.2 Your order will only be processed once an authorisation code has been received. Cheques and postal orders take a minimum of 10 days from receipt until payment has cleared then goods can be released for dispatch.

10. Delivery
10.1 Please be aware of the following two conditions of delivery;
(i) Goods will only be shipped to the card holder’s verified home address.
(ii) The majority of deliveries will require a signature.

10.2 Delivery Times, we at High End Cable aim to dispatch your order as soon as possible the vast majority of our orders are dispatched within one working day of receiving them. We endeavour to dispatch orders placed before 3.00pm (Mon – Fri) the same day. Unfortunately, orders placed on Saturdays and Sundays will be dispatched as soon as possible on the Monday with the exception of Bank Holidays.

10.3 European Deliveries, while we treat all orders with the same high level of consideration, we will endeavour to dispatch all orders as soon as possible. However, we cannot, and will not be held responsible for European (non-UK) postage / delivery times. European orders may take up to seven working days to reach their destination.

10.4 We will endeavour to deliver goods within the times stated but goods are subject to availability and sometimes delays are outside our control. We shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay in the delivery of the goods, if they are delivered within a reasonable period of time.

10.5 Regarding failed deliveries of goods which have been returned to us owing to a breach of contract by the consumer. Customers will receive an email from us, informing them that they have 7 days to contact us to rearrange delivery. Failing this, the goods will be returned to stock and a refund will be processed less a £20.00 administration charge.

11. Shipping
11.1 Packages less than 2kg are sent 1st Class Recorded Signed For, which includes a tracking service if required.

11.2 Packages over 2kg are sent via Royal Mail Insured Parcel Service, delivery may take up to 5 working days. All goods must be signed for. Should there be no-one to sign for the goods, the post / courier will leave a card, and you can re-arrange a delivery time to suit.

11.3 UK Customers, If you have not received your goods 5 working days after receiving an e-mail confirming the dispatch of your goods, please notify us via our ‘Contact Us’ page, providing your order number, name, address, and brief details of what you ordered.

11.4 European deliveries will be shipped via the fastest and most cost effective means available to us at any given time.

11.5 Special Orders, such as bespoke lengths of Interconnect / Loudspeaker cables, and certain goods not regarded as normal stock items, may possibly take longer to dispatch, as we would be waiting for our suppliers / manufacturers, to dispatch these special orders on to us.

12. Acceptance & Risk
12.1 Upon a signed delivery of goods to your door you will be responsible for them. We will only deliver goods to the address on the order and goods will not be left without a signature.

12.2 When your goods are delivered, check the condition of the boxes and please sign for them as ‘Unchecked’.

12.3 You must ensure that you only sign for the correct number of boxes, only sign for the number actually delivered.

12.4 Any shortages should be noted on the delivery consignment note at the time of delivery as this may prejudice your claim if later, items are found to be missing.

12.5 Always check the driver's delivery paperwork before signing with your signature. If goods are signed for, but the damage was not apparent at time of delivery, you must notify us via email before 1pm on the next working day after delivery. Should you fail to do so, we cannot accept any liability for the damage; delay may well prejudice your claim later.

12.6 If boxes are damaged upon delivery you should write ‘Damaged’ on the delivery consignment note.

12.7 In all cases, please notify us.

12.8 From the time of a signed delivery of goods, any loss or damage to the goods not reported to us before 1pm on the next working day after delivery, shall be at your own risk.

12.9 Once we have been notified of damage or loss, we will collect or replace the damaged / missing item(s) as soon as possible after notification.

13. Shortages, Incorrect or Damaged Goods / Deliveries

13.1 Please read clause 12 above.

14. Notification of Claims
14.1 Please read clause 12.7 above.

15. Guarantees

15.2 The guarantee does not apply to misuse, such as liquid spilt on products, or commercial use leading to excessive wear and tear.

15.3 Any repairs done to any product, other than by ourselves or authorised agents our guarantee becomes invalid. If you modify, tamper with or otherwise alter a product, your guarantee will become void.

15.4 The guarantee will not apply to any damage or faults caused by user error or neglect.

15.5 The guarantee will not apply if the serial number on the product has been altered.

15.6 Consumable products carry a minimum of 3 months guarantee i.e. batteries, etc. This guarantee specifically excludes faults by accident, neglect and misuse.

15.7 Second Hand, ex-dem or end of line have reduced warranty as indicated at the time and in some cases makers only warranty.

15.8 International buyers are covered by UK rules only and not neccessarily those of their own Country.

16. Cancellation and Returns Policy
16.1 Cancelling your order.
(i) Please notify us by email before we have dispatched the goods to you.
(ii) However, if the goods have already been dispatched to you, by returning goods to us in accordance with clause’s listed below.

16.2 You can return goods you have ordered from us at any time within 7 days of receipt for a full refund or exchange less original shipping costs. The costs of returning any goods to us will be at your own expense.

16.3 Please notify us by email, of your intentions and we will supply a Returns number. Please write the Returns number clearly of a piece of paper and place inside the package / box.

16.4 Do not write the Returns number on the goods, nor its package / box.

16.5 Upon receipt of the goods in good condition, see clause 16.8 & 16.9, we will give you a refund of the amount paid less 10%, see clause 16.6 or an exchange / credit note as required within 30 days.

The rights to return the goods to us as referred to in clause 16.2 will not apply in the following circumstances.
(i) In the event that the goods have been opened and / or used.
(ii) To any goods that have been specifically made / modified to your specification, for example, terminated speaker cables, etc.
(iii) If you have written the Returns number on the goods or its package / box.

16.6 As we only offer free delivery on purchases, and hence, by returning the goods to us, you are no longer making a purchase, we will deduct 10% of the total cost, to cover re-stocking, handling and postage, otherwise we would be trading at a loss.

16.7 You must return the goods to us within 7 working days of contacting us about your return.

16.8 You must ensure goods are fully insured (to the replacement value of the goods) in transit. You are liable for the delivery of the goods back to us within 7 working days, this must include loss and / or damage.

16.9 Notes on Returning Goods.
(i) The purchaser should make certain that the goods they are returning have no physical damage; the goods MUST be in perfect condition, unused, unopened, and complete with all parts with all relevant instructions books and accessories included, along with all packing in the original packaging.
(ii) The purchaser is responsible for ensuring that the returning goods are well packed and protected to a level that is fit for purpose, e.g. to be handled by the local postal service. If the goods returned are damaged due to lack of care / poor packing, no refund will be given.
(iii) A charge for missing items, such as boxes, instruction booklets, and / or adaptors will be made, this charge will also include a handling / labour charge to cover the time and cost of sorting out any missing items with our suppliers.
(iv) See clause 5.2

16.10 The facility to cancel an order is not intended to be used as a way to try multiple products. If a customer purchases and returns products regularly, we will not process any further orders from that customer. See clause 1.4.

16.11 Cable goods deemed to be a special order are not bound by the returns policy. Special goods are usually advised at the time of order but in general and cable length with 0.25m, 0.5m or 0.75m, 1.25m, 1.5m or 1.75m and so on come under this catogory. Once ordered the customer must complete the sale or subject to restocking charges of 50% of the order value. This applies to specially made up cables only as some brands are available as standard.

17. Faulty Goods and Returns Policy
17.1 Faulty Goods from Date of Delivery. In the event that the goods we have supplied to you are defective in any way, we will issue you with a replacement free of charge, and we will reimburse you the full cost of shipping the product back to High End Cable. Simply use the ‘Contact Us’ page and we will then e-mail you a Returns Number along with further instructions. Items on Second Hand page or those sold as ex-dem or end of line have reduced warranty as indicated and in some cases makers only warranty.

18. Errors and Omissions
18.1 In the event that any of are goods are listed or quoted at an incorrect price due to an error from our suppliers or publishers. We reserve the right to refuse any orders listed at the incorrect price. If your credit / debit card has been charged and we subsequently cancel your order, we will immediately issue a refund to your credit / debit card.

We, and any other party (whether or not involved in creating, producing, maintaining or delivering our website), and any of our group companies and the officers, directors, employees, shareholders or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with our website in any way or in connection with the use, inability to use or the results of use of our website, any websites linked to our website or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing our website or your downloading of any material from our website or any websites linked to our website.
